The present general conditions of sale apply to the sales of jewels and services concluded on the Site. They are likely to be modified without notice and will then be immediately published on the Site. We invite you to read them before or during the validation of your order.
I. Full and entire application
I.1 The use of the site as well as any order on the site implies prior consultation and full and complete acceptance of these general conditions of sale. These can be consulted at any time on this page.
I.2 The use of the site is reserved for adults and capable persons, individuals or professionals.
II. Orders
II.1 Placing an order
To place an order, the customer selects the items he wants by clicking on the “Add to cart” button. The customer can consult and modify the contents of his basket at any time until the final validation of his order.
II.2 Information required to order
During the creation of his customer account or during his order, the customer is invited to communicate his name, first name, home address, delivery address, billing address, e-mail address, telephone number and method of payment.
II.3. Validation and registration of an order
Once his order information has been filled in and verified, the customer can validate his order by clicking on the button validate payment. He is then deemed to have accepted the order in all its terms and without reservation.
II.4. Confirmation of order
Once the order has been validated, the customer receives a confirmation email. We recommend that you keep this email for possible future reference.
III. Order
Unless otherwise specified, our orders are payable in Euros and are subject to change without notice. The prices indicated include French VAT at the rate of 20%.
III.1 Payment
The customer can pay for his order by credit card (Carte Bleue, Visa, MasterCard, America Express…), via the payment platform Stripe (https://stripe.com/fr).
III.2 Invoicing
Once the customer’s order has been validated, the customer receives an invoice by email. The customer’s invoices are also available online on the site in the “My Account” section.
III.3. Verification of payment
We reserve the right to check the identity of the customer, in particular by asking him to provide us with proof of identity.
III.4. Price to be paid
The price to be paid is the one indicated during the final validation of the order.
III.5 Price display error
In the event of an error on the display of a price of an ordered item, the displayed price being obviously derisory, we reserve the right to cancel the customer’s order. If necessary, we would immediately inform the customer and propose either the cancellation of his order and its reimbursement, or, if he wishes, the validation of his order at the actual price.
IV. Deliveries and withdrawal of orders
IV.1 Delivery costs
We are happy to offer you worldwide shipping charges.
IV. 2. delivery within the European Union
In accordance with regulations, new jewelry is subject to VAT at the rate of 20%. Second-hand jewelry, known as “vintage” jewelry are not subject to VAT. In all cases, the displayed prices include VAT when it applies.
When the customer is a professional subject to VAT, he is invited to indicate his intra-community VAT identification number when validating his order. If his VAT number is validated by the VIES system, the price to be paid will then be reduced by the applicable French VAT, the customer being then responsible for the VAT that he may be liable for in the country of delivery.
IV.3 Exports outside the European Union
Any order placed from a country outside the European Union is an export. As such, it is exempted from VAT on the jewels which are subjected to it. The price to be paid by the customer will therefore be a price excluding taxes. The customer will be responsible for any customs duties and other taxes that may be due upon importation of these products. If necessary, we invite the customer to consult the competent authorities in his country of importation before any order.
IV.4 Split shipments
For reasons of guarantee and security, we may have to ship an order by split shipments. If this is the case, the customer will be informed by e-mail.
IV.5. Delivery follow-up
The customer can follow the delivery of his order on the Site from his “My Account” space.
IV.6. Withdrawal of an order in the store
The customer has the possibility to pick up his order in the store, 29, rue Pastorelli 06000 Nice, France, during opening hours. The Customer can also delegate any adult and capable person of his choice by communicating his identity by email. The designated person will have to present himself with an identity document and a power of attorney signed by the Customer.
IV.7. Delivery times
Delivery times are indicative and do not engage our responsibility. In case of non-delivery within 30 days from the validation of the order and in accordance with the regulations, the customer will have the possibility to cancel his order and obtain a full refund, excluding any other compensation, and except special indications indicated to the customer before validation of his order and subject to full payment of the price.
IV.8. Delay of delivery
In case of late delivery of a package, the customer is invited to contact our Customer Service by the means of his choice (e-mail, telephone, mail, fax). We will then search for this package with our carrier. If this package is found, it will be readdressed as soon as possible to the customer at the delivery address indicated in his order. In case of loss of the parcel, we will proceed to a new delivery at our expense if the jewels are still in stock. Otherwise, we will propose to the customer a replacement of articles with, if necessary, refund of the remainder, or a full refund.
IV.9. Place of Delivery
Except for withdrawal in the store, all orders are delivered to the delivery address indicated at the time of the order and delivered against the customer’s signature.
IV.10. Absence at the time of delivery
If the customer is absent at the time of delivery, the carrier will leave a calling card inviting the customer to contact the carrier to arrange another delivery day or to collect the package at a defined collection point.
IV.11. Verification of products upon delivery
The customer is obliged to check the number and condition of the parcels delivered in the presence of the deliverer. In case of doubt, he can refuse the package and then immediately notify us by the fastest means (ideally by email or telephone).
In case of refusal of the package and if the product(s) ordered are no longer available, the provisions of Article IV.8 will be applied. In case of exchange, the delivery costs are at the expense of the customer.
V. Jewelry
V.1 Presentation of the jewels on the site
We put our best efforts to present the jewels in the most precise and detailed way possible. Thus, the jewelry can be presented in dimensions greater or smaller than its actual dimensions.
Moreover, the colors of the jewels presented may vary depending on the terminal and/or screen used and their configuration.
The photographs of the jewels have an illustrative character. The customer is invited to take note of the descriptive elements of each jewel to know precisely its characteristics. Our Customer Service is available by form or by telephone to provide the customer with any additional information he would like to receive.
VI. Right of Withdrawal and Returns
VI.1 Right of Withdrawal
In accordance with Article L. 121-20 of the French Consumer Code, the Customer has a period of 14 clear days from the date of receipt to return the products ordered remotely, at his expense, for reimbursement, without justification or penalty.
The Customer must imperatively inform our Customer Service in writing or by telephone and follow exactly the return process that we will indicate.
VI.2 Return conditions
The acceptance of a return implies strict compliance with the following conditions:
The items must be returned in perfect condition for resale, in their original state (packaging, accessories, instructions …), duly sealed, and accompanied by the signed return form.
Items worn (excluding fittings) or returned incomplete, damaged, damaged or soiled will not be taken back under any circumstances.
The returned jewels will be the subject of a new expertise by our services. They will have to confirm that these jewels did not undergo any modification, alteration or damage;
the procedure of return must be strictly respected;
The Customer is perfectly informed that the personalized products, engraved, put to size or cut, cannot be the subject of a right of retractation on his part and are thus neither taken again, nor exchanged, nor refunded.
All certified diamonds, purchased by our services on behalf of the Customer, are neither exchanged nor taken back, given their unique character.
Reminder of applicable legal texts
Article L. 211-4 of the Consumer Code: The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. It is also liable for defects of conformity resulting from packaging, assembly instructions or installation when the latter has been charged to it by the contract or has been carried out under its responsibility.
Article L. 211-5 of the Consumer Code: To be in conformity with the contract, the goods must :
1° Be fit for the use usually expected of a similar good and, where applicable :
Correspond to the description given by the seller and have the qualities that the seller has
Presented to the buyer as a sample or model ;
Present the qualities that a buyer can legitimately expect with respect to the statements
Publicity made by the seller, by the producer or his representative, especially in advertising
Or labelling ;
2° Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the knowledge of the seller and accepted by the latter.
Article L. 211-12 of the Consumer Code: The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.
Article 1641 of the Civil Code: The seller is bound by the warranty on account of hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have paid a lower price for it, if he had known about them.
Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser, within two years from the discovery of the defect. »
VII. Applicable Law and Dispute Resolution
The interpretation of these General Terms and Conditions of Sale and Service shall be governed by French law applicable in metropolitan France. Any difficulty relating to the order, the payment, the delivery or the exercise of a guarantee of the products and services will have to be the subject of a direct complaint near our services in order to have a fast amicable settlement.
Any dispute falls under the jurisdiction of the courts of Nice, France.
